General Questions

Yes. Prenuptial agreements are recognised by courts in England and Wales when certain conditions are met. These include full and honest financial disclosure, independent legal advice for both partners, and signing the agreement well in advance of the wedding. While no prenup can guarantee an outcome in every circumstance, agreements that follow these principles are routinely given significant weight by the courts.

Yes. For a prenuptial agreement to be taken seriously by the courts, each partner must receive independent legal advice. Prenuply arranges this for both of you with separate, SRA-regulated family law solicitors as part of the fixed fee.

Yes. The entire process is completed online, including: Providing your information and financial disclosure, Meeting your solicitor by video call, Reviewing and approving the agreement, and Receiving your final documents. There is no need to visit a law firm in person.

Most couples complete the process within three to four weeks. Timing depends on how quickly both partners provide information, schedule their solicitor meetings, and review the draft agreement. We recommend starting well in advance of your wedding date.

FAQs

The Process

Once you begin: 1. Both partners complete a short eligibility check and financial disclosure. 2. Each of you selects an independent solicitor and attends an online meeting. 3. A draft prenuptial agreement is prepared. 4. You review the draft together and submit any agreed changes. 5. The final agreement is issued with certificates of independent legal advice.

The service includes one structured round of revisions, submitted jointly by both partners after reviewing the draft. This approach keeps the process fair, efficient, and legally sound. If further changes are needed later, these can be handled separately.

Prenuply is designed to support open, balanced discussions between both partners. Your solicitors will prepare a draft agreement based on your disclosures and the information provided. You will then be able to review the draft together and request revisions as part of the process. A prenuptial agreement can only be finalised if both partners consent to the terms. If you are unable to reach agreement on the draft within the included review period, the Prenuply process cannot move forward. At that point, you may choose to seek further advice independently or explore alternative options outside the platform.

No. Signing is completed digitally after both of you have received independent legal advice. Your solicitors provide certificates confirming that advice was given, which form part of the final agreement.
